1. ขอบเขตของนโยบาย

นโยบายฉบับนี้กำหนดหลักเกณฑ์ เงื่อนไข และขั้นตอนในการยื่นและพิจารณาคำขอของเจ้าของที่พัก รวมถึงการหักเงินประกันและการเรียกเก็บเงินจากผู้เช่า สำหรับจำนวนเงินที่เจ้าของที่พักมีสิทธิเรียกร้องจากผู้เช่าตามสัญญาเช่า

นโยบายฉบับนี้ใช้เฉพาะกับการจองที่ได้รับการยืนยันผ่านแพลตฟอร์ม Nomavaa โดยการจอง สัญญาเช่า และการชำระเงินสำหรับที่พักดังกล่าวต้องดำเนินการผ่าน Nomavaa และเจ้าของที่พักต้องปฏิบัติตามสัญญาเช่า ข้อกำหนดและเงื่อนไข และนโยบายที่ใช้บังคับ

นโยบายฉบับนี้เป็นส่วนหนึ่งของข้อกำหนดและเงื่อนไขของ Nomavaa และให้อ่านร่วมกับสัญญาเช่า นโยบายการชำระเงินและเงินประกันสำหรับผู้เช่า และนโยบายอื่นที่ใช้บังคับกับการจองนั้น

2. จำนวนเงินประกันการเช่าสำหรับเจ้าของที่พัก

จำนวนเงินประกันการเช่ากำหนดตามระยะเวลาการเช่า ดังต่อไปนี้

ค่าเช่ารายเดือน 2 เดือน

“ค่าเช่ารายเดือน” หมายถึงค่าเช่ารายเดือนที่กำหนดไว้ในการจองและสัญญาเช่า โดยไม่รวมเงินประกัน ค่าทำความสะอาด หรือจำนวนเงินอื่นใด

3. รายการที่สามารถขอหักหรือเรียกเก็บได้

เจ้าของที่พักสามารถยื่นคำขอได้เฉพาะรายการที่เจ้าของที่พักมีสิทธิเรียกร้องจากผู้เช่าตามสัญญาเช่า เช่น

3.1. ค่าเช่าหรือค่าสาธารณูปโภคที่ค้างชำระ

3.2. ความเสียหายต่อที่พัก เฟอร์นิเจอร์ เครื่องใช้ไฟฟ้า หรือทรัพย์สินภายในที่พัก

3.3. ค่าปรับหรือจำนวนเงินอื่นที่เรียกได้โดยชอบตามสัญญาเช่าหรือกฎของที่พัก

Nomavaa จะพิจารณาจากข้อมูลและหลักฐานว่ารายการและจำนวนเงินที่ขอหักหรือเรียกเก็บมีเหตุรองรับและสมเหตุสมผลหรือไม่

4. รายการที่ไม่สามารถขอหักหรือเรียกเก็บผ่าน Nomavaa ได้

เจ้าของที่พักไม่สามารถขอหักเงินประกันหรือให้ Nomavaa เรียกเก็บเงินสำหรับรายการดังต่อไปนี้

4.1. ความเสื่อมสภาพของที่พัก เฟอร์นิเจอร์ เครื่องใช้ไฟฟ้าหรือทรัพย์สินใด ๆ ในที่พักอันเกิดจากการใช้งานตามปกติ

4.2. ความเสียหายที่มีอยู่ก่อนการเช่า หรือเกิดจากการเสื่อมสภาพ การขาดการบำรุงรักษา หรือความขัดข้องของอุปกรณ์ตามปกติ

4.3. ความเสียหายที่เกิดจากการกระทำหรือการละเลยของเจ้าของที่พักในการดูแลรักษาที่พัก

4.4. การสูญเสียรายได้ ค่าเสียโอกาส ค่าเดินทาง ความเสียหายทางจิตใจ หรือความเสียหายทางอ้อมอื่น

4.5. จำนวนเงินที่ไม่มีหลักฐานเพียงพอหรือสูงเกินสมควร

4.6. จำนวนเงินที่เจ้าของที่พักได้รับชำระแล้วจากผู้เช่า บุคคลภายนอก ประกันภัย หรือแหล่งอื่นแล้ว

5. การยื่นคำขอ

5.1. เจ้าของที่พักต้องตรวจสอบที่พักและแจ้ง Nomavaa ภายใน 3 วันนับจากวันที่ผู้เช่าย้ายออก โดยระบุรายการและจำนวนเงินที่ขอหักหรือเรียกเก็บ หากยังไม่สามารถระบุจำนวนเงินที่แน่นอนได้ เจ้าของที่พักอาจแจ้งจำนวนเงินโดยประมาณภายในระยะเวลา 3 วันดังกล่าวก่อน แต่ต้องแจ้งรายการให้ครบแต่แรก

5.2. หากจำนวนเงินที่แน่นอนหรือหลักฐานไม่พร้อมสำหรับจัดส่งภายในระยะเวลาตามข้อ 5.1 เจ้าของที่พักต้องแจ้งจำนวนเงินที่แน่นอนและนำส่งหลักฐานเพิ่มเติมให้แก่ Nomavaa ภายใน 7 วันนับจากวันที่ผู้เช่าย้ายออก ทั้งนี้ เจ้าของที่พักไม่สามารถเพิ่มรายการที่ขอหักหรือเรียกเก็บภายหลังพ้นระยะเวลาตามข้อ 5.1 ได้

5.3. หลักฐานตามที่ระบุในข้อนี้อาจรวมถึงภาพถ่ายหรือวิดีโอก่อนและหลังการเข้าพัก รายการทรัพย์สิน ใบแจ้งหนี้ ใบเสร็จรับเงิน ใบเสนอราคา หลักฐานการค้างชำระ หรือเอกสารอื่นใดที่เกี่ยวข้อง

6. การชี้แจงของผู้เช่าและการพิจารณา

Nomavaa จะแจ้งรายการและจำนวนเงินที่เจ้าของที่พักขอหักหรือเรียกเก็บให้ผู้เช่าทราบ และเปิดโอกาสให้ผู้เช่าชี้แจง โต้แย้ง หรือจัดส่งหลักฐานภายใน 3 วันนับจากวันที่ได้รับแจ้ง

หากผู้เช่าไม่ตอบกลับภายในกำหนด Nomavaa อาจพิจารณาคำขอจากข้อมูลและหลักฐานที่มีอยู่ ทั้งนี้การไม่ตอบกลับของผู้เช่าไม่ทำให้คำขอได้รับอนุมัติโดยอัตโนมัติ

Nomavaa จะพิจารณาความเพียงพอของหลักฐานและความสมเหตุสมผลของจำนวนเงินที่ขอหักหรือเรียกเก็บ โดยสำหรับทรัพย์สินที่ต้องเปลี่ยนใหม่ Nomavaa จะคำนึงถึงสภาพเดิม อายุการใช้งาน และค่าเสื่อมราคาตามปกติของทรัพย์สินก่อนเกิดความเสียหาย

Nomavaa จะดำเนินการพิจารณาภายในระยะเวลาที่สมเหตุสมผลหลังจากได้รับข้อมูลและหลักฐานครบถ้วน

7. การจ่ายเงินให้แก่เจ้าของที่พัก

สำหรับจำนวนเงินที่หักจากเงินประกันได้ Nomavaa จะดำเนินการโอนให้แก่เจ้าของที่พักภายใน 7 วันทำการนับจากวันที่แจ้งผลการพิจารณา

สำหรับจำนวนเงินที่ Nomavaa เรียกเก็บเพิ่มเติมจากผู้เช่าได้ Nomavaa จะดำเนินการโอนให้แก่เจ้าของที่พักภายใน 7 วันทำการนับจากวันที่ Nomavaa ได้รับเงินดังกล่าวจากผู้เช่า

ระยะเวลาดังกล่าวหมายถึงระยะเวลาที่ Nomavaa จะดำเนินการโอนเงิน โดยระยะเวลาที่เงินเข้าบัญชีของเจ้าของที่พักอาจขึ้นอยู่กับธนาคารหรือผู้ให้บริการชำระเงินที่เกี่ยวข้อง

การคืนเงินประกันส่วนที่เหลือให้แก่ผู้เช่าให้เป็นไปตามนโยบายการชำระเงินและเงินประกันสำหรับผู้เช่า

8. การเรียกเก็บเงินจากผู้เช่าและสิทธิของเจ้าของที่พัก

เจ้าของที่พักตกลงให้ Nomavaa แจ้งรายการหักเงินหรือรายการเรียกเก็บแก่ผู้เช่า เรียกร้องและรับชำระเงินจากผู้เช่าในส่วนที่เกี่ยวข้องกับคำขอในนามของเจ้าของที่พัก

หากจำนวนเงินที่เจ้าของที่พักมีสิทธิเรียกร้องจากผู้เช่าสูงกว่าเงินประกันที่ Nomavaa ได้รับและสามารถนำมาหักได้สำหรับการจองนั้น Nomavaa อาจดำเนินการเรียกเก็บจำนวนเงินส่วนที่เหลือจากผู้เช่าในนามของเจ้าของที่พัก

Nomavaa ไม่มีหน้าที่ชำระจำนวนเงินที่ยังไม่ได้รับจากผู้เช่าแทนผู้เช่า เว้นแต่ Nomavaa จะตกลงเป็นลายลักษณ์อักษรเป็นอย่างอื่น

หาก Nomavaa ไม่สามารถเรียกเก็บจำนวนเงินทั้งหมดจากผู้เช่าได้ เจ้าของที่พักยังคงมีสิทธิเรียกร้องจำนวนเงินส่วนที่เหลือจากผู้เช่าโดยตรงตามสัญญาเช่าหรือกฎหมาย แต่ต้องไม่เรียกร้องหรือรับชำระซ้ำสำหรับรายการเดียวกัน

Nomavaa ไม่รับประกันว่าจะสามารถเรียกเก็บจำนวนเงินทั้งหมดหรือบางส่วนจากผู้เช่าได้

9. ข้อมูลไม่ถูกต้องและการไม่ให้ความร่วมมือ

Nomavaa อาจปฏิเสธหรือยกเลิกคำขอ ระงับการจ่ายเงิน หรือเรียกคืนจำนวนเงินที่จ่ายให้แก่เจ้าของที่พักไปแล้ว หากเจ้าของที่พัก

9.1. ให้ข้อมูลหรือหลักฐานอันเป็นเท็จ ทำให้เข้าใจผิด หรือปลอมแปลง

9.2. ปกปิดข้อเท็จจริงสำคัญที่เกี่ยวข้องกับคำขอ

9.3. ไม่จัดส่งข้อมูลหรือหลักฐานที่จำเป็นภายในระยะเวลาที่กำหนด

9.4. ไม่ให้ความร่วมมือในการตรวจสอบคำขอ

Landlord Claims Resolution Policy

Effective Date: 8 August 2026

1. Scope of the Policy

This Policy sets out the criteria, conditions, and procedures for Landlords to submit claims for amounts owed by Tenants under the Lease Agreement, and for Nomavaa to review those claims, make deductions from the Security Deposit, and facilitate collection from the Tenant.

This Policy applies only to bookings confirmed through the Nomavaa platform. The booking, Lease Agreement, and payments relating to the Property must be processed through Nomavaa, and the Landlord must comply with the Lease Agreement, Nomavaa’s Terms and Conditions, and all applicable policies.

Any amendment or renewal of a Lease Agreement that is not processed through Nomavaa is not covered by this Policy.

This Policy is provided as part of Nomavaa’s platform services. It is not an insurance policy or insurance contract, and Nomavaa does not insure against all risks or losses that may arise from renting out the Accommodation.

This Policy forms part of Nomavaa’s Terms and Conditions and must be read together with the Lease Agreement, the Tenant Payment and Security Deposit Policy, and any other policies applicable to the booking.

2. Rental Security Amount for Landlords

The Rental Security Amount is determined according to the rental period as follows:

“Monthly Rent” means the monthly rent specified in the booking and the Lease Agreement, excluding the Security Deposit, cleaning fees, and any other amounts.

3. Items Eligible for Deduction or Collection

A Landlord may submit a claim only for an amount that the Landlord is entitled to recover from the Tenant under the Lease Agreement, including:

3.1. Unpaid rent or utilities;

3.2. Damage to the Property, furniture, appliances, or other property within the Property;

3.3. Penalties or other amounts lawfully recoverable under the Lease Agreement or the House Rules.

Nomavaa will review the information and evidence provided to determine whether each claimed item is sufficiently supported and whether the amount claimed is reasonable.

4. Items Not Eligible for Deduction or Collection Through Nomavaa

A Landlord may not request a deduction from the Security Deposit or request Nomavaa to collect payment for:

4.1. Ordinary wear and tear affecting the Property, furniture, appliances, or other property within the Property;

4.2. Pre-existing damage or damage resulting from deterioration, inadequate maintenance, or the ordinary malfunction of equipment;

4.3. Damage resulting from any act or omission of the Landlord in maintaining the Property;

4.4. Loss of income, loss of opportunity, travel expenses, emotional distress, or any other indirect or consequential loss;

4.5. Any amount that is not supported by sufficient evidence or is unreasonably high; or

4.6. Any amount that the Landlord has already received from the Tenant, a third party, an insurer, or any other source.

5. Submission of a Claim

5.1. The Landlord must inspect the Property and notify Nomavaa within 3 days from the date the Tenant moves out, specifying the items and amounts claimed for deduction or collection. If the Landlord is unable to determine the exact amount, the Landlord may initially provide an estimated amount within that three-day period but must identify all claimed items in the initial notice.

5.2. If the exact amount or supporting evidence is not available for submission within the period specified in Section 5.1, the Landlord must notify Nomavaa of the exact amount and submit any additional supporting evidence within 7 days from the date the Tenant moves out. The Landlord may not add any further items claimed for deduction or collection after the period specified in Section 5.1 has expired.

5.3. Supporting evidence under this Section may include photographs or videos taken before and after the Tenant’s stay, inventory records, invoices, receipts, quotations, evidence of outstanding amounts, or any other relevant documents.

6. Tenant’s Response and Review of the Claim

Nomavaa will notify the Tenant of the items and amounts claimed by the Landlord and give the Tenant 3 days from receipt of the notice to provide an explanation, dispute the claim, or submit supporting evidence.

If the Tenant does not respond within this period, Nomavaa may review the claim based on the information and evidence available. The Tenant’s failure to respond does not result in the claim being approved automatically.

Nomavaa will consider whether the evidence is sufficient and whether the amounts claimed are reasonable. If a damaged item must be replaced, Nomavaa will take into account its condition before the damage occurred, its useful life, and ordinary depreciation.

Nomavaa will complete its review within a reasonable period after receiving all required information and evidence.

7. Payment to the Landlord

For any approved amount that may be deducted from the Security Deposit, Nomavaa will transfer that amount to the Landlord within 7 business days after notifying the parties of its decision.

For any additional amount that Nomavaa successfully collects from the Tenant, Nomavaa will transfer that amount to the Landlord within 7 business days after receiving it from the Tenant.

These periods refer to the time within which Nomavaa will initiate the transfer. The time required for the funds to be credited to the Landlord’s account may depend on the relevant bank or payment service provider.

Any remaining balance of the Security Deposit will be refunded to the Tenant in accordance with the Tenant Payment and Security Deposit Policy.

8. Collection from the Tenant and the Landlord’s Rights

The Landlord agrees that Nomavaa may, on the Landlord’s behalf, notify the Tenant of any deductions or charges and request and receive payment from the Tenant in connection with the claim.

If the amount that the Landlord is entitled to recover from the Tenant exceeds the Security Deposit received by Nomavaa and available for deduction in respect of the booking, Nomavaa may seek to collect the remaining amount from the Tenant on the Landlord’s behalf.

Nomavaa is not required to pay on behalf of the Tenant any amount that Nomavaa has not received from the Tenant, unless Nomavaa expressly agrees otherwise in writing.

If Nomavaa is unable to collect the full amount from the Tenant, the Landlord retains the right to recover the remaining amount directly from the Tenant under the Lease Agreement or applicable law. However, the Landlord must not claim or receive payment more than once for the same item.

Nomavaa does not guarantee that it will be able to collect all or any part of an amount from the Tenant.

9. False or Misleading Information and Failure to Cooperate

Nomavaa may reject or cancel a claim, suspend payment, or recover any amount already paid to the Landlord if the Landlord:

9.1. Provides false, misleading, or fabricated information or evidence;

9.2. Conceals any material fact relating to the claim;

9.3. Fails to provide required information or evidence within the prescribed period; or

9.4. Fails to cooperate with Nomavaa’s review of the claim.
